EDUTECHNOZ TERMS AND CONDITIONS

Welcome to edutechnoz.com (“Edutechnoz”, “our”, “us” or “we”). If you (“you”, “your” “User”) visit or use the services offered at Edutechnoz’s website (the “Site”) you accept these Terms and Conditions, our Privacy Policy and any additional terms applicable to certain programs in which you participate that exist on the site from time to time (collectively the “Terms and Conditions” or “Agreement”). Please read these Terms and Conditions carefully before using the Site.
YOUR USE OF THE SITE CONSTITUTES YOUR ACCEPTANCE OF AND AGREEMENT TO ALL OF THE TERMS IN THESE TERMS AND CONDITIONS. If you do not agree to be bound by the Terms and Conditions in its entirety, then you must immediately stop using the Site.
TUTORING SERVICES TERMS
I understand that session placement will be decided based on student's assessment results.
I confirm that I was informed about the policy of attendance, which dictates that the child has to attend all sessions. To change class schedule, we need 48 hours notice.
I understand that I will not interfere with the teacher during the session and if I have questions, comments or concerns, I will communicate them with management.
I will always show respect to eduTechnoz teachers & staff.
In the rare event of disrespectful encounter with our teachers, eduTechnoz reserves the right to suspend or expel the student without offering any refunds.
Refund & Cancellation:
A full credit or refund less Enrollment Fees & attended classes will apply if withdrawal is made before third (3) session/class
No Refund or credit will be provided for withdrawal after 3rd class, regardless of attendance. No credit will be provided for missed classes.
Our sessions might be recorded for training and quality assurance purposes. All recordings are stored and archived on our secured cloud with limited access.
IF YOU ARE A PARENT OR GUARDIAN AND YOU PROVIDE YOUR CONSENT TO YOUR CHILD’S REGISTRATION WITH THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS IN RESPECT TO THEIR USE OF THE SITE.
Note that special terms may apply to some services offered on the Site. These terms are posted in connection with the applicable service. Subject to applicable law, any such terms are in addition to these Terms and Conditions, and in the event of a conflict, prevail over these Terms and Conditions.
These Terms and Conditions are subject to change at any time, effective upon posting on the Site. Your use of the Site after such posting will constitute your acceptance of and agreement to such changes. Therefore, you should frequently review these Terms and Conditions to see if they have been changed.
Account, Password and Security
You may create only one account. In creating your account you will provide accurate information. If you provide false or fraudulent information in connection with your account or with your use of this Site, your account will be terminated and we reserve the right to hold you liable for any and all damages and to pursue legal action.
Your account is non-transferrable and may not be sold, combined or shares with any other person. You are the sole authorized user of your account. You are responsible for maintaining the confidentiality of any password and account number provided by you or Edutechnoz for accessing the Site. You are solely and fully responsible for all activities that occur under your password or account. Edutechnoz has no control over the use of any account and expressly disclaims any liability derived therefrom. Should you suspect that any unauthorized party may be using your password or account or you suspect any other breach of security, you will contact Edutechnoz immediately.
We use Paypal payment processing services to bill you for goods and services. We will share your Personal Information as necessary for Paypal to provide these services. Please see Paypal privacy policies for more about their security and privacy practices.
Conduct on the Site
Your conduct on this Site must be lawful and comply with these Terms and Conditions. The following activities are prohibited on the site and will result in the termination of your account:
(a) submitting false, inaccurate, incomplete or misleading information;
(b) submitting fraudulent information;
(c) infringing any third party's copyright, patent, trademark, trade secret or other proprietary right or rights of publicity or privacy;
(d) violation of any law, statute, ordinance, or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);
(e) posting any defamatory, libelous, unlawfully threatening, or unlawfully harassing content;
(f) posting obscene content or content containing child pornography or content that may be harmful to minors;
(g) attempting to interfere with the Site in any manner, including, without limitation by means of submitting viruses, Trojan Horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information;
(h) reselling or repurposing your access to the Site or any purchases made through the Site;
(i) Using the Site or any of its resources to solicit Users, Merchants or any business partners of Edutechnoz to in direct or indirect competition with Edutechnoz, either online or offline; and
(j) create liability for Edutechnoz or cause Edutechnoz to lose (in whole or in part) the services of its ISPs or other partners or suppliers.
Goods and Services On The Site
From time to time, you may purchase goods or services on the Site. You acknowledge that only an adult (18 years or older) can enter into and complete any such transaction.
All charges are exclusive of all taxes, governmental duties and imposts of whatsoever sort or nature. All Taxes where and when applicable including but not limited to withholding Taxes shall be borne or reimbursed by the Customer.
OUR PAID SUBSCRIPTION SERVICES ARE AUTOMATICALLY RENEWABLE. THE SUBSCRIPTION WILL CONTINUE UNTIL YOU TERMINATE THE CONTRACT. IF YOU WANT TO CANCEL THE CONTRACT YOU MUST CANCEL 30 DAYS PRIOR TO THE DATE OF RENEWAL. THERE ARE NO REFUNDS FOR EARLY TERMINATION OF THE CONTRACT. THE RENEWAL CHARGE WILL BE THE SAME AS THE ORIGINAL SUBSCRIPTION FEE, UNLESS WE NOTIFY YOU IN WRITING THAT THE AMOUNT WILL CHANGE AND THE AMOUNT OF THE CHANGE. THE DURATION OF THE AUTOMATIC RENEWAL WILL BE ON A CONTINUING BASIS.

Modifications To The Service
Edutechnoz reserves the right in its sole discretion to review, improve, modify or discontinue, temporarily or permanently, the Site or any content or information on the Site with or without notice. Edutechnoz will not be liable to any party for any modification or discontinuance of the Site. You will be notified of any charges and given the option to continue to use or to terminate your account. You will be responsible for all charges for using these additional services if you choose to continue use.
Intellectual Property Rights
All text, graphics, editorial content, data, formatting, graphs, designs, HTML, look and feel, photographs, music, sounds, images, software, videos, designs, typefaces and other content (collectively "Proprietary Material") that users see or read on the Site is owned by Edutechnoz or are used by permission. Proprietary Material is protected in all forms, media and technologies now known or hereinafter developed. Edutechnoz owns all Proprietary Material as well as the coordination, selection, arrangement and enhancement of such Proprietary Materials. The Proprietary Material protected by the domestic and international laws of copyright, patents, and other proprietary rights and laws. Users may not copy, download, use, redesign, reconfigure, or retransmit anything from the Site without Edutechnoz's express prior written consent. Any use of such Proprietary Material, other than as permitted therein, is expressly prohibited without the prior permission of Edutechnoz and/or the relevant right holder.
The service marks and trademarks of Edutechnoz, including without limitation Edutechnoz and Edutechnoz logo are service marks owned by Edutechnoz. Any other trademarks, service marks, logos and/or trade names appearing on the Service are the property of their respective owners. You may not copy or use any of these marks, logos or trade names without the express prior written consent of the owner.

LIMITATION OF LIABILITY

THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW, AND SHALL SURVIVE ANY TERMINATION OR EXPIRATION OF THESE TERMS AND CONDITIONS OR YOUR USE OF THIS SITE OR THE SERVICES FOUND AT THIS SITE.
INDEMNIFICATION

General Provisions
This Terms and Conditions constitute the entire agreement between you and Edutechnoz with respect to its subject matter. If any provision of this Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will be enforced to the fullest extent possible, and the remaining provisions will remain in full force and effect. This Terms and Conditions will inure to the benefit of Edutechnoz, its successors and assigns.
License Grant
You hereby grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise all copyright, publicity rights, and any other rights you have in any statement or information posted on the Site (the “Content”), in any media now known or not currently known. Your license of any Content extends to use for promotions, advertising, market research or any other lawful purpose, without limitation.
Dispute Resolution; Governing Law; Jurisdiction; Venue; Waiver of Trial by Jury
To expedite resolution and reduce the cost of any dispute, controversy or claim related to these Terms and Conditions ("Dispute"), you and Edutechnoz agree to first attempt to negotiate any Disputes (except those Disputes expressly excluded below) informally for at least thirty (30) days before initiating any legal proceeding. Such informal negotiations will commence upon written notice. Your address for such notices is your billing address, with an email copy to the email address you have provided to Edutechnoz. Notices should be submitted to [email protected].
Subject to the requirements of applicable consumer rights and other laws, these Terms and Conditions shall be governed by and construed in accordance with the laws of Canada. You agree that any action relating to or arising out of these Terms and Conditions shall be brought in the courts of Ontario, Canada, and you hereby consent to (and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to) jurisdiction and venue in the courts of Ontario, Canada. You agree to waive the right to trial by jury in any action or proceeding that takes place relating to or arising out of these Terms and Conditions. You further agree to accept service of process by certified mail, return receipt requested at the address designated by you. Edutechnoz will be entitled to recover court costs and reasonable attorneys' fees and expenses incurred in successfully proving any breach of these Terms and Conditions.
No Waiver
Failure by Edutechnoz to enforce any provision(s) of these Terms and Conditions will not be construed as a waiver of any provision or right. It will be governed by and construed in accordance with the governing law herein.
Links to Other Web Sites
Links (such as hyperlinks) from Edutechnoz to other sites on the Web do not constitute the endorsement by Edutechnoz of those sites or their content. Such links are provided as an information service, for reference and convenience only. Edutechnoz does not control any such sites, and is not responsible for their content. The existence of links on the Site to such websites (including without limitation external websites that are framed by Edutechnoz Site as well as any advertisements displayed in connection therewith) does not mean that Edutechnoz endorses any of the material on such websites, or has any association with their operators. Each covenant and agreement in these Terms and Conditions shall be construed for all purposes to be a separate and independent covenant or agreement. If a court of competent jurisdiction holds any provision (or portion of a provision) of these Terms and Conditions to be illegal, invalid, or otherwise unenforceable, the remaining provisions (or portions of provisions) of these Terms and Conditions shall not be affected thereby and shall be found to be valid and enforceable to the fullest extent permitted by law.
